ITAR Explained: What It Is and Who It Covers

ITAR implements the Arms Export Control Act by controlling the export and temporary import of defense articles, technical data, and defense services that appear on the United States Munitions List (USML).
For a metal fabricator, ITAR matters when the parts it produces are listed on the USML. ITAR Registration vs. ITAR Compliance

Compliance is the ongoing operational discipline that follows it. A fabricator that holds active registration but exposes technical data to unauthorized people, fails to secure controlled areas, or neglects material traceability is registered but not compliant. There is no official "ITAR certification" issued by the government, so buyers should ask for active registration and a documented compliance program rather than a certificate.
What ITAR Controls in a Fabrication Environment
ITAR controls two broad categories of information and hardware. The first is technical data, which includes CAD models, engineering drawings, manufacturing notes, forming and bending instructions, weld procedures, test results, and even photos that reveal controlled design or production details. The second is the defense article itself, meaning the physical component being manufactured.
Access to both categories is restricted to U.S. persons, defined to include U.S. citizens, lawful permanent residents, and certain protected individuals. Disclosing controlled technical data to a foreign national inside the United States is treated as a "deemed export" and requires prior DDTC authorization. This has a direct consequence for outsourcing: a U.S. prime contractor cannot simply send USML drawings to any overseas shop. Material traceability is another pillar. Finally, all ITAR-related records, including access logs, visitor logs, shipping documents, and data transfers, must be retained for the period required by the regulations.
The Cost of Getting It Wrong
The penalties for ITAR violations are severe. Civil penalties can reach roughly $1.27 million per violation, or twice the transaction value, whichever is greater. Criminal penalties can reach $1 million in fines and up to 20 years in prison per count, with possible debarment from defense contracting. Personnel and data access failures, such as sharing controlled drawings with unapproved employees or using non-compliant cloud storage, are among the most common and costly violations in fabrication environments.

Because ITAR restricts controlled data to U.S. persons, international metal fabrication suppliers rarely handle USML technical data directly.
